EB-5 Process
The EB-5 visa is an employment-based immigrant visa category that allows foreign investors to obtain a U.S. green card by making a significant financial investment in a U.S. business that creates or preserves jobs for American workers.
Key Requirements
Investment Amount: A minimum of $1.05 million, or $800,000 if investing in a Targeted Employment Area (TEA) (high-unemployment or rural area).
Job Creation: The investment must create or preserve at least 10 full-time jobs for U.S. workers.
Eligible Businesses: Investments can be in a new commercial enterprise or a troubled business.
Process
File Form I-526E (Immigrant Petition by Standalone Investor) with evidence of the investment and job creation plan.
Upon approval, apply for conditional residency through adjustment of status or consular processing.
After two years, file Form I-829 to remove conditions on the green card, proving the investment met all requirements.
The EB-5 visa is popular for individuals seeking a direct path to U.S. permanent residency while contributing to the economy.
