Removal Proceedings Overview
Removal proceedings are legal processes to determine whether a non-citizen should be deported from the U.S. They begin when the Department of Homeland Security (DHS) issues a Notice to Appear (NTA), detailing the charges and reasons for removal.
The case is heard in immigration court under the jurisdiction of the Executive Office for Immigration Review (EOIR).
During the proceedings, the individual attends a Master Calendar Hearing, where they can plead to the charges and request relief options, such as asylum, cancellation of removal, or adjustment of status. A Merits Hearing is held to present evidence and arguments for relief from removal.
An immigration judge decides whether the person can stay in the U.S. or must be removed. Decisions can be appealed to the Board of Immigration Appeals (BIA) or federal courts. Legal representation is crucial throughout the process to ensure a fair chance at relief.
