PERM Process

The PERM process (Program Electronic Review Management) is a key step in obtaining an employment-based green card for certain categories like EB-2 and EB-3. It ensures that hiring a foreign worker will not negatively impact U.S. workers.

Employers define the job role, obtain a prevailing wage determination from the Department of Labor (DOL), and conduct a recruitment effort to test the U.S. labor market.

If no qualified U.S. worker is found, the employer files with the DOL for labor certification. 

Once approved, the employer can proceed with filing Form I-140 with USCIS to sponsor the worker for a green card. Compliance with DOL regulations is critical to success.
